These Terms of Use ("Terms") govern your use of the mobile game Movie Empire: Idle and related websites and services (the "Services") provided by "SmartThings" Limited Liability Company, Prospect Respublika, Building 24A, Baykonur District, Astana, Kazakhstan, 010000 ("SmartThings", "we"). By installing or using the Services you agree to these Terms. If you do not agree, do not use the Services.
These Terms are written in English and may be translated into other languages. The English text prevails in the event of any conflict.
1. Eligibility
You must be at least 13 years old (16 in the EU/EEA) to use the Services. If you are under the age of majority in your country, you may use the Services only with the consent of a parent or legal guardian who agrees to these Terms on your behalf.
2. Licence
We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to install and play the game on a device you own or control, for your own non-commercial entertainment. All rights not expressly granted remain with SmartThings and its licensors.
You may not: copy, modify, distribute, sell or rent any part of the Services; reverse engineer or attempt to extract the source code; use cheats, bots, automation, exploits or unauthorised third-party software; interfere with the operation of the Services or other players; or use the Services in violation of applicable law.
3. Virtual items and purchases
The game contains virtual currency and items ("Virtual Items") that can be earned in play or purchased with real money through the Apple App Store or Google Play. Virtual Items have no monetary value, cannot be exchanged for real money and are licensed to you, not sold. Purchases are processed by Apple or Google under their own terms; refunds are handled according to the store's policy. We may modify, rebalance or remove Virtual Items as part of updating the game.
Some Virtual Items are marked as permanent: they persist through in-game renovations and new game cycles on the device where they were obtained. Game progress is stored on your device; uninstalling the game deletes it.
4. Advertising
The game is free to play and shows advertising, including optional rewarded videos. Advertising is served by third-party partners described in our Privacy Policy.
5. Your content and feedback
If you send us feedback, suggestions or support requests, you grant SmartThings a perpetual, worldwide, royalty-free licence to use them for improving the Services, without any obligation to you. Do not send us content that is unlawful, offensive or infringes anyone's rights.
6. Intellectual property
The Services, including the game, its characters, artwork, code, music and text, are owned by SmartThings or its licensors and protected by copyright and other laws. "Movie Empire: Idle" and related logos are trademarks of SmartThings.
7. Availability and changes
We may update, suspend or discontinue the Services or any part of them at any time, with or without notice. We may also update these Terms; the effective date at the top will change, and material changes will be announced in the game or on our website. Continued use after the effective date means you accept the updated Terms.
8. Termination
We may suspend or terminate your access to the Services if you breach these Terms, including by cheating or abusing other players or our support. You may stop using the Services at any time by uninstalling the game.
9. Disclaimer and limitation of liability
The Services are provided "as is" and "as available", without warranties of any kind, to the fullest extent permitted by law. To the fullest extent permitted by law, SmartThings shall not be liable for any indirect, incidental or consequential damages, or for loss of data, Virtual Items or progress. Our total liability to you for any claim relating to the Services is limited to the amount you paid us in the twelve months before the claim arose. Nothing in these Terms limits liability that cannot be limited under applicable law, including consumer rights in your country of residence.
10. Governing law
These Terms are governed by the laws of the Republic of Kazakhstan, without prejudice to mandatory consumer protection rules of your country of residence. Disputes shall be resolved in the courts of Astana, Kazakhstan, unless applicable law provides otherwise.
